  1. Which personal data will be processed?

Personal data means any information regarding an individual. In the context of the provision of services, personal data may be processed to comply with the requirements of law and meet a legitimate interest of the controller.

For the purpose of subscription, we process your identification and contact data (name, surname, invoice address, mailing address, phone number, e-mail), the title ordered, number of copies, and date of commencement and end of the subscription.

In case of subscription for a person other that the one who placed the order, we process also the name and surname and mailing address of the beneficiary.

If you lodge a complaint regarding the delivery of a subscribed title, we will process information concerning the complaint (time of and reason for the complaint, the title subscribed for, the way in which the complaint was resolved). If you become entitled to a gift to be provided with your subscription, we will process information on the gift you gained and the time and way in which it was delivered to you, including a delivery receipt, if any.

We will use your e-mail address, phone number and information on the subscribed title to deliver to you commercial communications related to the offer of periodicals similar to that you have subscribed for. The legal ground based on which we carry out such processing is our company’s legitimate interest in developing our publishing operations. You may opt out of receiving the commercial communications at any time, in a manner specified in each commercial communication.

The provision of personal data is not mandatory; if you do not provide the personal data required for a subscription order, we cannot provide the subscription and enter into an appropriate contract with you.

In case of registration on the web sites of Business Media CZ s.r.o. (see Section 2: List of Servers) and in case that you place an order for newsletter deliveries, we process the following information: your name and surname, e-mail address, phone number. In case of registration of an account on the discussion web sites listed above, we record your nickname and password in an encrypted form.

Furthermore, we process any personal data that you provide to us in case that you apply for a job with our company. If so, we process your name, surname, degree and contact information, i.e., your e-mail and phone number, information on your highest education level and practice and, as the case may be, other personal data that you provide to us during the recruitment process.

  1. Reason for personal data processing

We primarily process your personal data to meet the legitimate interest of the controller. The provision of such personal data is mandatory; unless the personal data is provided for these purposes, the cooperation between the parties is impossible. To process the personal data for such purposes, we do not need your consent; processing for the purposes of contract performance and fulfilment of legal obligations cannot be refused. This covers, in particular, the following activities:

  1. user identification for providing access to the services rendered via the controller’s web site (see Section 2: List of Servers);
  2. activities aiming at entering into and performing a contract (including deliveries of goods and services) made with the data subject, including any administrative steps prior to entering into the contract made at the request of the data subject;
  3. information necessary for the fulfilment of a controller’s legal obligation, such as any tax liability arising from law;
  4. personal data necessary for the protection of legitimate interests of the data subject, i.e., information on the services requested and provided, payment habits, debtor records, collection of amounts owing by clients, resolution of complaints and disputes with clients, records of dealings with clients, written and electronic communication, service quality improvement, delivery of commercial communications including offers of products and services.

In case of the personal data of an individual – job applicant, we process their personal data to select a suitable job candidate in the process of carrying out steps aiming at the conclusion of a contract (recruitment process).

  1. Who will have access to your personal data?

Your personal data is safe with us. We carefully select our partners and employees who receive your personal data from us and are capable of implementing appropriate technical and organizational measures for protecting your personal data against unauthorized or accidental access or other misuse.

The protection of your personal data is our priority. All of our partners have the obligation of confidentiality and none of them is allowed to use the personal data provided to them for purposes other than those in relation to which you provided your personal data to us.

Your personal data may be processed for us only by processors working on the basis of a personal data processing contract.

Therefore, the third parties having access to your personal data may be as follows:

  1. persons through which we ensure deliveries and technical aspects of the operation of certain services, or operators of the technologies that we use to provide our services;
  2. persons providing to us legal and tax advice and tax audits in cases where it is necessary, and persons carrying out debt collection;
  3. persons through which we ensure sufficient protection and integrity of our services and web sites and test such protection on a regular basis.
  1. Cookies

Cookies are small data files thanks to which web sites can remember the user’s steps on and set up of the web site as a result of which such information needs not be entered repeatedly. Cookies are stored on a computer via a web browser. Cookies do not pose a risk; they are not used to obtain any sensitive personal data but are relevant as far as privacy protection is concerned.

We do not use cookies to identify web site users or abuse credentials.

We use cookies for three purposes. Firstly, we use cookies for the system to remember you when transferring from one web site to another. Such session cookie is active only during viewing a web site in an ordinary way; after you end using the web site/browser, the cookie is deleted automatically.

Another cookie type remembers your username or language so that you do not have to enter this information whenever you visit the site. This type of cookie remains stored on your computer after you close your browser.

Finally, we use cookies also for making analyses to obtain aggregated information on the total number of server visitors, visits duration, etc.

As a user, you have the option to refuse the use of cookies. If the use of cookies in your browser is allowed, you will be considered to have given consent to the use of standard cookies by our web sites. Standard web browsers (Internet Explorer, Mozilla Firefox, Google Chrome, etc.) support the administration of cookies. In your browser set up, you can manually delete, block or prohibit each cookie, or block or permit such cookies only with regard to specific web sites.   1. Personal data processing period

In general, we process and store your personal data only as long as necessary, i.e., during the term of contract and as long as we are required so by generally binding legal regulations.

We erase a data subject’s personal data when it is no longer necessary for accomplishing the purpose for which it was collected initially.

We must process your personal data which is necessary for providing our services properly, or fulfilling all our obligations, regardless of your consent for a period arising from or being in compliance with applicable legal regulations, i.e., no matter that you may have withdrawn your consent.  In accordance with applicable personal data protection regulations, your personal data will be discarded once the purpose of processing ceases to exist.

Any personal data which you provide to us in case that you apply for a job will be retained for twelve (12) months after such personal data has been provided.

  1. Your rights associated with personal data processing

You have the right to request access to your personal data at any time. This means that based on your request we will provide to you information on the personal data that we process, the purpose of such processing, the source from which the personal data was obtained, and the time for which it will be processed.

You have the right to request at any time that any inaccurate personal data be rectified or, as the case may be, completed in case it is incomplete.

In addition, you have the right to request erasure of any personal data which is no longer necessary in relation to the purposes for which it was originally collected, or if the controller is no longer entitled to use such personal data for other reasons (e.g., the personal data was processed unlawfully, or the erasure is required by law, etc.).

Furthermore, you have the right to object at any time to the processing of your personal data for the purposes of direct marketing (commercial communication deliveries). If you do so, your personal data will no longer be used for such purpose. You also have the right to object to the processing of your personal data if such right is based on your legitimate interest. In such circumstances, we will continue processing your personal data only if proved that there are serious legitimate grounds for doing so.

You have the right to request restriction of the processing of your personal data. This means that you may ask us not to erase your personal data which we otherwise would be obliged to erase and to no longer use your personal data until it is clarified whether the personal data being processed is accurate or whether your objection to the personal data processing is grounded.

In this connection, please note that we may require you to provide a suitable proof of identity so that your identity can be verified. This is a precautionary measure implemented in order to prevent access to your personal data by unauthorised persons. In order to improve the quality of services and retain records on the fulfilment of our obligations arising from law, any communication with you is subject to monitoring.

We will handle your personal data in a way which is in accordance with the Personal Data Protection Principles based on which the personal data was collected and also always in accordance with generally binding legal regulations governing personal data protection, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, and European personal data protection standards unless the data subject grants consent to other ways of personal data handling.
